Thai O Visas: What If My Spouse Passes Away?

This is certainly not a topic that one wants to discuss but "What happens if one is on an O Visa here in Thailand and their spouse passes away?" Well the bad news is the law is pretty strict on this. The good news is Immigration is empowered with a certain amount of discretion and I in my experience and we have dealt with this quite a few times, have only ever seen them exercise this in a very compassionate manner; exercise their discretion in a very compassionate manner when we see the Thai spouse of a foreign national pass away with respect to what to do with their Visa.
Generally speaking, and to be clear first of all note, a Visa is valid on its face until it is a permanently invalidated. That said if one's Thai spouse passes away, then if they are on an O Visa for marriage purposes here in Thailand, their visa no longer has any basis so if they visit Immigration or they have some dealing with authorities, it can be problematic if their spouse has passed away and they haven't dealt with their Visa yet.
That said, one can deal with Immigration. We have assisted folks in facilitating conversion to a different type of Visa category. It has usually been our experience, we convert folks over to an O Retirement Visa or possibly an O-A depending on circumstances but the long story short, it has been our experience that Immigration is not looking to cause a problem for those folks who are usually grieving under those circumstances and through no fault of their own, their visa is now invalidated or presumptively invalidated.
So the thing to take away from this video is yes there is a solution to that. It can be dealt with. It has been our experience that Thai Immigration is not looking to go out of their way to cause a problem for those who have lost their Thai spouse and they are now dealing with the Visa and Immigration ramifications with that here in the Kingdom of Thailand.
