YouTubing IS Working in Thailand Regardless of the Framing?

Transcript of the above video:

I have seen a lot of correspondence lately. I have seen a lot of stuff in forums and out even on Twitter and things, people talking about work authorization, working in Thailand, YouTubing in Thailand, all types of things. And there was something I saw and I didn't have time, it kind of got into my head and I didn't have time to pull it down and do a citation for it. But basically, I saw some folks talking in a forum and they were saying, "well you know, I'm coming to Thailand, I'll be doing some YouTubing, but that's not really working in Thailand."

Look, I get that there's been all of this discussion - it has not even had any legal effect - but we have seen with the DTV, we have seen with certain aspects of the LTR, that there is a difference if you will between so-called "remote working" and working in Thailand. Now the problem with that is the entire rubric was forged by frankly a Government that didn't really have a mandate to do that, and it was entirely the brainchild of the Ministry of Foreign Affairs and they don't seem to have gained any consensus with the Labour Department or internal Immigration under the auspices of the Ministry of Interior, so whatever. But the point of this video is that YouTubing is the exact opposite of remote working by every stretch of the word, by every stretch of the terminology. What do I mean?

Well remote working - and again there is no work authorization for this notion of remote working. I have never liked that they came up with this going back into 2024, going into 2025, what I call the Rump Coalition Government of the late Paetongtarn Shinawatra's Administration came up with this idea mostly through the rubric of the DTV, that “remote work” was okay. Now again, there was no broad consensus, nothing published in the Royal Gazette that changed the definition of work in Thailand, that all remains the same, but basically and the way that I have sort of looked at it and the way that I tell people to understand it, they are basically turning a blind eye if you are on a laptop and whatever you are doing, is the nexus of that business is occurring overseas; that's how I look at it. They are turning a blind eye. That is completely the opposite of what YouTubing is. You are in Thailand; you are in Thailand making YouTube videos in Thailand. That is precisely the opposite of remote work. And on top of that, there is no way to turn a blind eye. You have got documented video evidence of your work, legal or otherwise, in Thailand, if you are YouTubing as a foreigner in Thailand; that's how it comes out.

I am making this video more or less because I have had so many people, they send me emails say, "well.."  You are trying to play word games. I have talked about this at length in other videos. The definition of work in Thailand is so broad that breathing could in theory be construed as work if you want it to.

So the thing to take away from this video is especially as it pertains to you making your own video evidence of your work in Thailand, YouTubing is not going to be able to especially where it's occurring within Thailand - the nexus of the YouTube video, the background, the physical location of the video is Thailand - you are not going to be able to make even the most attenuated argument regarding remote work possibly fly.
