American SB-1 Returning Resident Visas

It is getting to be that time of the year. I've been kind of thinking about the content on the channel and it's about time to do some videos that may kind of rehash some things or we may be treading over old ground when we are talking about this stuff, but it is incumbent on me to always remember especially going into high seasons that there are people that are new to Thailand and there are people that are new to dealing with the US Immigration system. 

In one area, it does come up, this video will probably, I would be even shocked if it breaks a few hundred views this video itself, but when this issue arises in a given person's life, in a given person's situation, it is significant and that issue is one of being abroad and having one's Green Card either expire or lose their Green Card, or being abroad so long that it raises the presumption of Abandonment of Permanent Residence and that brings up the issue of what's called an SB-1 Returning Resident Visa. And what is that?

Well an SB-1 Returning Resident Visa basically allows somebody who's had Green Card status that might have been outside of the United States for a prolonged period of time and they may have seen, again it depends on circumstances whether somebody needs to use this type of Visa, but maybe they've had their Green Card lost, maybe their Green Card has been stolen, they no longer have the actual I-51 document itself, and they need to go ahead and go through a process in order to get re-admitted to the United States. Oftentimes the best way to go about doing that is through usage of an SB-1 Returning Resident Visa. Again it depends on the facts of a given case whether or not an SB-1 Returning Resident Visa is warranted.

Again if you just lost or stolen a Green Card, excuse me, you haven't stolen one, but had one stolen, and you have not been abroad for a particularly long period of time, then there may be other options. But again in either case if you are thinking about retaking residence in the United States and you have issues travelling back there, it may not be a terrible idea to contact a legal professional, gain some insight and guidance into how best to proceed.
