Can K-3, CR-1, IR-1 Visas Be Processed Out Of Thailand, Laos, Cambodia, or Myanmar?
Transcript of the above video:
As the title of this video suggests, we are discussing can a K-3, CR-1 or IR-1 Visa i.e. a Marriage Visa still be processed out of Thailand, Laos, Cambodia and/or Myanmar?
The answer is as folks may be aware from having watched our channel previously, Trump has placed a "pause" if you will on the issuance of Immigrant Visas from Thailand, Laos, Cambodia and Myanmar at least for now. I will get into it in a moment when I think it's going to end.
First off, one thing - and I brought this up in other videos - I don't see why Thailand was added to this list. Thailand has always been considered a low fraud post, or not a high fraud post, so to begin with I find it kind of nonsensical. Also, Thailand is America's oldest Ally in Asia, so I question whether or not this was necessary, but here we are. Now what do I think is going to happen? Recently we have been trying to make interview appointments for visas, and we are being successful in doing that, but most of them are now being issued in April. My gut tells me that we are going to see about a quarter-long retooling of what's called the Public Charge Rule associated with US Immigration i.e. the method of analysis by which Consular Officers determine whether or not somebody is likely to become a "public charge" in the United States, i.e. an immigrant comes into the United States only to go on welfare. That's basically what they are retooling is they are retooling the analytical framework for determining that. And I think based on what I am seeing practically in the current process, we will probably see the Visa pause ending sometime in about April. I can't say that for certain but based on what I am seeing where there are interviews being now scheduled at that time, that may provide some insight that, hey they're waiting until then to do the interview, at a time when they know or are substantially certain that they are actually going to be able to issue the Visa. Again, that is a bit of speculation on my part, but that's the best data point I have on the ground for dealing with this that can allow me to provide any predictions, at least as it pertains to Thailand. I can't really speak to matters pertaining to Visas being processed out of Cambodia, Laos or Myanmar at this time.
That said, it is still possible to file for immigration benefits for a loved one from any of those countries, so under current circumstances, the best thing to do if you're looking at bringing a spouse to the United States, is to get your case into the system so that it can inevitably be processed and eventually you can get the visa interview and presumably be able to get the visa issued. That being said, we will certainly be keeping folks updated on this channel as situation evolves.
