Can Retirees in Thailand Get a K-1 Fiancée Visa?

This video today is kind of going to have some overlap from some major topics we talk about oftentimes on this channel and that is retirement issues, issues associated with retirees here in Thailand as well as US Immigration. I have been a US Immigration Attorney for 15 years; I have been primarily dealing with cases out of Thailand the entirety of that time. A lot of people ask me they have said "look, I am a retiree in Thailand" and oftentimes I will get these questions after their fiancée has been denied a visa to the USA as a tourist and then they will say well, oftentimes this comes up it is people that kind of want to live half time here, half time there or do three months back in the States, usually the summers especially with the older guys, and then the winters over here where it is nice and warm, I totally get that. The point of the video though is for retirees, "can I get a K-1 Visa? can I get a Fiancé Visa for my fiancée and if so, sort of the ramifications of that?"
First off, I want to preface this by saying everybody's situation is going to be different so again it might not be a bad idea to contact a legal professional if you have issues in a specific case. That said yeah it is possible for a retiree to get a K-1 Fiancé Visa for a Thai fiancée. Bear in mind there are financial obligations which have to be met in order for that K-1 Visa to be issued. Obligations might not be the right word. Perhaps I should say financial requirements associated with that and different people are going to be able to meet those requirements or not, depending on their circumstances.
The thing to take away from this video is yes it is certainly possible to get a fiancée over to the United States. The thing to bear in mind is once in the US then you have got to look at dealing with things like adjustment of status to Green Card status, Lawful Permanent Residence, which at that point a couple could in theory travel back and forth on a regular basis, sort of maintain two domiciles if you will in both Thailand and the USA. Yeah that's a possibility but understand there are a lot of requirements these days associated with the K-1 and the overall process is long. One's paradigm with respect to the K-1 should not be "hey this is just a matter of weeks or months", but yeah you are going to file it and then you are going to wait around and it could be a year. It could be more than a year right now under current processing times. So something to think about, something to understand when looking at the situation with respect to both being retired in Thailand as well as getting someone, specifically a loved one in this case a fiancée, back to the United States.
