Expiration Dates Associated With K-1 Fiancée Visas

As the title of this video suggests, we are discussing K-1 Fiancée Visas which is a frequent topic on this channel. People actually have asked me recently they said "why do you make so many videos on US Immigration? They have the least amount of views of all your videos." That is why this channel was actually started. I have been doing US Immigration for going on 17 years now and that was the primary thing that I did when I first arrived here in Thailand, before I was a Thai citizen, it was pretty much exclusively what I engaged in. 

The thing to understand and to take away from this video is the fact that K-1 Visas have expiration dates. What is interesting is there are different expiration dates associated with different aspects of the Visas. So for example the Visa itself, when you can use the sticker and it is a one-time use Visa the K-1 Fiancée Visa, but how soon do you have to use it? Generally speaking, it is going to be issued with six months validity. Now the underlying documentation associated with the K-1 Visa may result in the expiration date being sooner or faster if you will, than 6 months and again that is going to depend on specifics in the given case. Those who are issued a K-1 Visa, the first thing you ought to do is look at that expiration date; understand when it expires, so you can make travel plans accordingly. 

There is also another expiration date associated with the K-1 Visa which is the 90 days upon arrival in the United States. You have 90 days in which to get married and file for Adjustment of Status. Failure to get married in the 90 days can result in somebody falling over into overstay and thereby being considered in illegal status in the United States. The other thing to bear in mind is those who go into the United States and don't get married, those folks should turn around and return to their home country, in this case we are primarily talking about Thailand. 

So the thing to understand is there a really two expiration dates associated with the K-1 Visa. One is the expiration of the face usage of the Visa, the sticker itself, so if you will to face value of the Visa, when that expires and again generally it's 6 months but look at the expiration date the minute you get the visa so you can ascertain when it needs to be used. The other thing to bear in mind is yes, there is an expiration date, you have to use it within 90 days of arrival, excuse me not use it, you have to go ahead and get married and file for Adjustment of Status to Lawful Permanent Residence within 90 days of arrival in the USA.
