How Would You Change the K-1 Visa Process?
Transcript of the above video:
As the title of this video suggests, the question is being posited, "what would you do to change the K-1 Visa process?" Yeah, I have been pretty vocal in my critique of the overall US Immigration process as it presently exists, so some people have asked me, “well what would you do? how would you change it?”
I'll tell you what I would do. I would completely take DHS out of it; I would no longer have these cases processed through the Department of Homeland Security, especially K-1s, because they pertain to the family member of a US citizen, immediate family member, a spouse basically, a prospective spouse. I think under those circumstances to me it seems pretty straight, to my mind it is my opinion these cases should just be processed through the Embassies abroad. I don't understand the months and months and months these cases can take at Department of Homeland Security. I don't get that. They need to be processed abroad; they need to be dealt with just directly at an Embassy, in my opinion or a Consulate abroad. I think that would be a much better way to handle these things sort of akin to direct Consular filings when we used to be able, well in theory it is possible to do those although in point of fact, it is pretty rare that you will see one that even meets the requirements and even then, sometimes they won't exercise discretion to allow it. We used to be able to deal with what we called local filings here at the USCIS Office here in Bangkok and that was a matter of dealing with stuff in a matter of months. Now and yeah okay you can blame COVID a little bit, but the system also has a lot to do with the backlog which now runs into the years in some cases.
So if it were me and I was sort of able to make those changes to the overall Immigration process, if I was able to just wave a magic wand and do with it as I please, I would just have everything adjudicated at Embassies and Consulates abroad, especially in the context of the K-1.
