I Have Filed for K-1 Visa Before, Can I Get a New One?

As the title of this video suggests, we are discussing K-1 Fiancé Visas. The question being posed is: "I have applied for a K-1 Visa before, (so presumably this is the petitioner) I have sought a K-1 petition on behalf of my fiancée before, can I get another one?"

Well unfortunately pursuant to the terms of the International Marriage Broker Regulation Act, or IMBRA, there are certain limits on how many K-1 Visas one can apply for. Meanwhile, there is a mechanism for overcoming the bar but it requires a waiver. Now I am not going to get too deep into this about the waiver process because it is going to be very fact specific; it is going to depend on the specifics of a given case. 

Long story short, yeah it is possible to file for more than one, petition for more than one K-1 Visa but it is not a foregone conclusion that it will be possible to ultimately get multiple K-1 Visas issued for the same petitioner especially if the time frame of the different applications is very close together. Again, other factors are going to weigh in to this. If you are looking at this and you have filed for multiple K-1s in the past, it may not be a terrible idea to contact a legal professional, gain some insight and guidance into how best to proceed.
