The Importance of Competent Drafting of Thai Prenuptial Agreements

As the title of this video suggests, we are discussing prenuptial agreements. This comes up somewhat often in the context especially when we are dealing with Immigration to the United States. I made another video contemporaneously with this one where we discuss K-1 Fiancé Visas and how they can interact with prenuptial agreements. I urge folks to stay tuned on this channel for that. 

The notion of prenups in general, yeah there is both a Thai and an English language component to those. There also may be jurisdictional components associated with a Thai-English prenup wherein you have got to deal with analysis of how that instrument will operate in for example the United States and specifically which state, as well as Thailand as a jurisdiction generally. So a lot of analysis at play. I think a lot of people, in fact I have seen it over the years, I think a lot of folks they think it is an easier thing than it is or it is a more straightforward thing than it is. In point of fact, a competently drafted Thai-English prenup, I work with the Thai Attorneys here where I am dealing with the English side, the American legal side of things and they are dealing with all the Thai legal matters. Again, I am an American Attorney; I am a Thai citizen but I am not a Thai Attorney, I am an American Attorney who happens to be Thai, but the Thai legal staff tend to handle that. They draft that part and then we sort of put it together if you will, we sort of consolidate the two sides.

So, it is something that really needs to be done right and it really needs to be done in such a way that you are taking a look at all the different angles with respect to the different jurisdictions which could one day be involved.
