K-1 Fiancé Visas: What if my Fiancée Tries to Marry Someone Else?

As the title of this video suggests, we are discussing K-1 Fiancé visas. I actually was talking with someone the other day about the K-1 and he said this in a joking manner but he brought up something that I think is video worthy because it is something that nobody really thinks of but there is sort of a legal take on this if you will; the law speaks to this already.  

I was talking to this person and he said, "Well what happens if she gets here and she marries somebody else?" and he was completely joking, and I thought it was really funny because they have been together for a number of years and he just he was just joking with me. I said "Well sir, actually she can't and expect to adjust status on that K-1 Visa."  

A lot of people don't really know this but the K-1 is specific to that petitioner so if someone comes in on a K-1 Fiancé Visa and on the Visa itself it says "fiancé of…" and names the petitioner. That person has to go ahead and marry that petitioner or leave within 90 days least they fall out of status and they end up being out of status in the US; they are in the US illegally. 

So the interesting thing to take away from this is yeah there really isn't any avenue for someone to come to the US on a K-1 and just abandon whoever they were intending to marry and just marry someone else. They could marry someone else there is nothing precluding them for getting married but they cannot use that marriage as a basis for seeking an Adjustment of Status to long term lawful permanent residence status i.e. Green Card status in the United States.
