K-1, K-3, CR-1, and IR-1 Visa Interviews Restarting in April?

I've been talking about this for a while. So going back into January, there was an announcement of the Trump Visa ban, which turned out to be a pause. As we have discussed in other videos, the Administration has taken it upon themselves to pause visa processing associated with Immigrant Visas, specifically Immigrant Visas. I get into some analysis on the difference between Immigrant and Non-immigrant Visas in another video I made contemporaneously with this one, so stay tuned for that. 

But that said, what we are talking about here is basically this Administration has said we are putting a moratorium on issuing visas from certain parts of the world. Thailand was included on the list and for the life of me I still don't understand why they were, but okay. In any event, that placed us under this pause while they are sort of retooling the framework by which they adjudicate what's called the Public Charge Rule, so basically adjudicating whether or not or ascertaining whether or not somebody is likely to become a public charge in the United States as a result of going to the United States. They are basically saying, "hey we want to look and see if you might end up becoming a welfare recipient, we need to put a pause on these visas in order to retool our approach to doing that." 

Now back in December, I actually saw a waiver case get approved and then we immediately turned around and requested interviews so that we could get the visa issued. They came back and said the nearest interview is April. Now this was before the Visa pause was announced, so it's my opinion that this policy was being brought down. They already had basically told, I think, this is again some level of speculation, but they told the Embassy out here, "hey don't schedule anything until April." My thinking is that the Visa pause may come to an end then. What we do know as I've got a number of cases now scheduled for interviewing April is that we are at least finally seeing the interviews for the K-1, K-3, CR-1 and IR-1. 

Now as I get into in other videos, the K-1 and the K-3 are technically Non-immigrant Visas so whether or not they are going to actually be impacted by this Visa pause remains to be seen, and as a practical matter, I'm not going to personally know that for my own case load and then be able to talk about it definitively on this channel until I start seeing some movement through the Embassy coming up here in April. So until that time, I haven't been able to comment one way or the other about whether or not maybe perhaps K-1s will continue to be processed. 

That being said, we are coming up on to April. I currently in my case load have interviews set for April, so we're going to see how all of this plays out. I am hopeful that this Visa pause is ending. But that said, it remains to be seen, and we will certainly be keeping you updated on this channel as the situation evolves.
