K-1 Visa Applications and Petitioner's Prior Arrest

Transcript of the above video:

As the title of this video suggests, we are discussing K-1 Fiancé Visas. We are discussing applications, petitions for K-1 Fiancé visas and petitioner's arrests, prior arrests. This can have a substantial impact on the processing of a K-1 Visa because that arrest record is often sought in these K-1 cases.

Now it may not necessarily be such a big issue in certain Marriage Visa cases but in the K-1s they have changed a lot of the regulations associated with the Fiancé Visa. At one time, arrests were not a huge issue. There were some issues associated with prior domestic abuse arrests but now these days, one's overarching record is subject to scrutiny by the Immigration apparatus. Finding the documentation associated with this and presenting it correctly can pose, I hesitate to say problems, but can pose challenges to those who are looking to get a K-1 Fiancé Visa for a foreign fiancé.

For this reason, I am not saying do-it-yourself Visa applications are necessarily a bad thing but I would say in cases where the petitioner has one or more prior arrests, it may not be a terrible idea to contact a legal professional, gain some insight and guidance into how best to proceed.
