K-1 Visa Issued in Thailand Amidst Trump "Pause"?
Transcript of the above video:
As the title of this video suggests, we are discussing K-1 Fiancé(e) Visas and hey, good news. I've been talking about Trump's Visa "pause", since going back into January. For those who are unaware, the Trump Administration made an announcement that they would be "banning", that was the initial wording, then they said okay it's a "pause" of Immigrant Visas and it was based on the notion that they are retooling the analytical infrastructure associated with determining whether or not someone is likely to become a public charge in the United States i.e. become a welfare recipient in the United States and we are dealing with the issues associated with that pause.
But a bit of good news on this. As I discussed in prior videos, I have had a few cases started going through interview process here at the Embassy this past April. We're now in the 1st of May here and the first couple of cases are being sort of held up. One of them involves a waiver that I don't really understand why it is being held up this point. The whole thing has been adjudicated. That said, it's a non-routine case; I'm used to that kind of treatment on non-routine cases. That said, in light of the circumstances, I think it's about time to think it's done and over with. Another one involved a third-country national; I'll get into that in another video made contemporaneously with this one. Then we had a third K-1 visa application go to interview shortly after that, and I am pleased to report it issued, they actually issued the Visa. So it was approved and I actually saw the visa in my hand yesterday, the day before the filming of this video.
And yeah, so I can report now, the Embassy is issuing Fiancé(e) Visas, albeit not in the same manner that they once did. It's a much slower process, there's much more scrutiny associated with visa interview, the application itself, but at the end of the day yeah, the Visa itself was issued. I had another case go to interview right around the same time - probably within a day or so of that case - and that one got 221g'd on document related stuff. Hopefully we'll be able to remedy the 221g and go ahead and go from there. That said, it's good news. There is some light at the end of this sort of tunnel if you will. There are visas actually being issued, so I can report that.
For those who are unaware, the K-1 Fiancé(e) Visa is a Non-Immigrant Visa which seems to be playing into the analysis of this, because again the pause pertains directly to Immigrant Visas. I guess the thinking is that well it's only a 90-day Visa that allows somebody to go the United States for 90 days; they then have to adjust status in the United States to Green Card status after getting married. At that point, they can assess whether or not that person is likely to become a public charge so it's not something that has to be dealt with at this phase. That seems to be the paradigm prevailing at the moment.
That being said, the thing to take away from this video is yes, they are ultimately issuing visas, albeit in a much different way than we've seen in the past. I'll certainly be keeping folks updated on this channel as the situation evolves.
