As the title of this video suggests, we are discussing K-1 Fiancé Visas. For those who are unaware, there is a pretty hard and fast meeting requirement associated with the K-1 Fiancé Visa. There are some exceptions to this meeting requirement. We have discussed this in other videos but long story short, the K-1 Visa requires that the couple have physically been in each other's presence within two years of the filing of the underlying petition and this is pretty hard to get waived. In my experience, it has only happened in such a low number of cases I can think of off the top of my head that it is definitely less than the fingers on one of my hands, the times I have seen this meeting requirement actually be waived.

This brings us to the question of “Well we have had this ongoing relationship. We haven't been able to meet due to travel restrictions." The good news on that point is travel restrictions are starting to ease especially here in Thailand but understanding that this remains an issue, understand that I have had a lot of people ask "well can we cite the travel restrictions as a reason for possibly getting a waiver?" Depending on circumstances, that may be possible but that's definitely very, very much an uphill battle and by uphill battle I mean we are talking steep, we are talking Himalayas in terms of trying to overcome that by citing these travel restrictions. 

Now that stated, again every case is different. It is going to be based on the underlying circumstances in that case so it may be possible. Again probably not a bad idea to contact a legal professional, gain some insight and guidance into how best to proceed.
