K-1 Visas, Prenuptial Agreements, And Timing

As the title of this video suggests, we are discussing K-1 Fiancé Visas, Prenuptial Agreements and the timing associated with both. For those who are unaware, the K-1 Visa is a Visa for fiancés. It is for American citizens specifically, it's not for Lawful Permanent Residents, it is for those who are American citizens who wish to petition to bring their fiancé to the United States in order to get married. 

Now we oftentimes will get calls from folks asking us about prenuptial agreements, about American Marriage Visas, marriage in Thailand and look at the end of the day there is a lot of timing elements that come into play here. There are also a lot of elements of formality associated with prenuptial agreements that can lead to situations wherein it's not exactly the most conducive thing to the given couples' particular lifestyle circumstances that they get married beforehand and then file for immigrant benefits. Oftentimes, although not in every case because each case is circumstantially different, oftentimes we will see a situation wherein especially where a prenuptial agreement is involved, it may be better to just do a Fiancé Visa, deal with all the formalities associated with the drafting and the review of a prenuptial agreement and then actually get married in the United States, due to issues associated with timing as well as matters pertaining to International conflict of laws and multiple jurisdictions which we have discussed in another video I have made contemporaneously with this one. Yeah when you are dealing with a prenup, sometimes it is just going to be more expedient to go ahead and get a Fiancé Visa; again different cases are going to operate differently as we have discussed in many other videos.

But the thing to take away from this video is to understand, you probably, especially if you are not yet legally married, keep an open mind regarding whether or not you are really hell bent or sort of your mind is set if you will on getting a Marriage Visa because a Fiancé Visa may be way more conducive to not only smooth processing in getting your fiancé into the United States, but it also made facilitate proper formality and proper drafting of a prenuptial agreement as well.
