K-1 Visas from Thailand: Is Adjustment Now the Issue?

Transcript of the above video:

Doing an update with regard to sort of K-1 Visa processing. Just an overall thought I wanted to add on the overall theme of just K-1 Visas out of Thailand generally is the issue, to my mind right now, it looks like family-based legal immigration is not a huge priority of this Administration, unlike the first Trump Administration where so-called “chain migration” etc. was a priority. And I totally get that in a domestic context in the United States by the way especially in light of the, for no other word for it, invasion of the United States we have seen the last four years, I get this chain migration stuff in an American domestic context, but family based Immigration for those who want to legally get into the United States - the fiancé(e), the spouse of an American citizen - that should not be a major priority of the administration in my opinion and I don't even think the administration wants that to be a priority. From their own statements, they clearly are concerned with illegal immigration, as they should be. The people that are abiding by the law and going through due process are the people that we want to encourage.

That said, the point I'm trying to make with this video is okay, there's the K-1 Fiancé Visa, that is an option out there. I personally think - I could be wrong - but I think "going after" these if you will - put "going after" in quotes - is not going to be a priority of this Administration. But understand, the K-1 Fiancé Visa - just getting that - is not really the end of the road in terms of the overall process. Now our service here oftentimes that is the end of the road for us because people will go to the United States and then choose to do what's called Adjustment of Status, that's getting married, applying for a green card in the US. Sometimes they'll do it on their own, sometimes they'll hire local counsel in America. In a minority of cases there are folks that just say, "nah, you have got everything; file it for us and then we will deal with it as it comes Stateside", so we do handle filings on Adjustment of Status as and when it is necessary. But honestly, it's two different processes is the way to look at it. One is the visa to get in, one is the adjustment of status.

Moving forward, I don't think the K-1 is necessarily going to be prioritized in terms of attention or negative attention from the administration. That said, I expect that the process to adjust status could become more cumbersome as the weeks and months roll on.
