K-1 Visas from Thailand: Marriage Requirements

As the title of this video suggests, we are discussing K-1 Fiancé Visas. We are specifically asking the question 'what are the marriage requirements?' 

So okay, first of all a K-1 Fiancé visa is specifically for fiancés, it is not for those who are married to an American. If you are already married, if you are legally married in a jurisdiction, Fiancé Visa is not going to be the right fit for you because you are not eligible for it. If you are not yet married, then yes you can apply for a K-1 Fiancé Visa so long as you meet the underlying requirements. I have other videos on this channel where we go into the requirements but now let's get to the point where the K-1 Visa is issued, you are on your way to the United States, what is the marriage requirement? 

Well the marriage requirement is that you get married within 90 days of the issuance of the Visa; that is the fundamental requirement. So within 90 days of arrival in the United States you need to get married. Then a lot of people ask me the question: "Well what kind of marriage do I need to do?" Any kind you want as long as it a legal marriage. Many of our clients just run down to a courthouse to deal with the legalities and then they deal with their own marriage celebration, their solemnization on their own, sort of on their own. They sort of do them as two different functions. That's one way to do it. You can also do it the standard, old-fashioned way; do a marriage license and have an efficient of your faith, however you want to deal with it, and deal with it that way. 

But long story short is yeah you need to get married within the 90 days of physical lawful presence in the United States in K-1 status and then yes you can file for what is called adjustment of status to Green Card status which will then allow you to go ahead and remain in the United States as a Lawful Permanent Resident thereafter.
