K-3 CR-1 and IR-1 Visas: Getting Married in Thailand

Transcript of the above video:

As the title of this video suggests, we are discussing US Marriage Visas specifically K-3, CR-1 and IR-1 visas and we are asking the question "well we are talking just what about getting married in Thailand?" Unfortunately, for folks who were looking to have a more how shall I say it, a little bit more faster process associated with getting into the United States, getting married in Thailand may actually slow things down comparatively. What am I saying about this?

A K-1 Visa, a Fiancé Visa sometimes can process more quickly than the Marriage Visas for a number of different reasons most notably in the case of the CR-1 and IR-1 Visa, the K-1 Visa doesn't have to deal with, quite frankly the vagaries of the National Visa Center. It just bypasses that. It hits NVC and NVC sort of acts like a Postmaster and sends it on to the Embassy. That in my opinion truncates the overall processing time substantially. Which brings up the question, a lot of folks will contact us about a US Marriage Visa after they have gotten married. It may not be a bad idea to contact a legal professional before you ever decide to get married or before you ever get married if that is on your mind as it is probably a good idea to have that person analyze your situation and provide you with some feedback regarding whether or not in your circumstances that is the best way to go. Or more to the point, the way that I usually do things, just lay out all the different options before you make a decision which can detrimentally impact whether you can pursue one of those other options.

So something to think about. Yes it is possible for an American and a Thai to get married in Thailand; it is possible for an American and someone of another nationality to get married in Thailand. Thailand operates a Civil Law system; it has a Civil Registrar system for getting married so it is I won't say it is the easiest thing in the world but it can be very straightforward for those who know what they are doing. So again, it may not be a terrible idea to contact a legal professional, gain some insight and guidance into how best to proceed.
