Original Divorce Decrees Required in K-1 Visa Applications?

As the title of this video suggests, we are discussing Divorce Decrees in the context of the K-1 Fiancé(e) Visa. I'm primarily speaking about this from the context of those processing through the US Embassy here in Bangkok as that is the bulk of the case load that we undertake here in our office.

Now this video almost feels like a bit of déjà vu because I made a video very similar to this during Trump's first administration because we first saw this development occur at that time, and now it appears to be back. Yes, in many of the interviews we are now seeing that have gone to interview regarding the K-1 - and I have done other videos in the past on the fact that yeah, Trump's Visa ban, now called a Visa pause has sort of, it slowed way down Visa processing; Immigrant Visas, we are still seeing if that's even possible to deal with those, but I did have a K-1 Visa get issued. I've got another one sitting in 221(g) under the auspices of administrative processing in light of an approved I-601 Waiver, which that one to my mind makes the least amount of sense of anything I've seen coming out of there. But then we saw another one involving a 221(g) refusal pending further documentation and the request from the Embassy was they wanted to see an original Divorce Decree; they wanted one actually issued and essentially embossed by the Clerk of the Court. I have talked about this in the past. Copies have always been okay, and then during Trump's first term, they changed that and they wanted to see this before we dealt with it at that time. Now again it looks like they are doing it again, that they want to see this again; during Biden this wasn't particularly much of a problem. That's not to say we didn't have any 221(g)s under Biden; that did occur, not infrequently. But yeah, this is a new one. 

This is sort of, I don't know how to say it other than it looks like the Administration wants to be intentionally sort of “nitpickity” or persnickety if you will, in seeing these original divorce documentation. Fine, like with all these 221(g)s, at the end of the day, it's basically a matter of just getting them what they want and processing it on through. 

That being said, it remains to be seen how this plays out, so we will certainly be keeping folks updated on this channel as the situation evolves.
