Processing A K-3 Visa In 2024?

Transcript of the above video:

As the title of this video suggests, we are discussing K-3 Marriage Visas. Now for those who are unaware, this is a Non-Immigrant Visa, the K-3. It was created by President Clinton under the Life Act which basically there was a time in the United States when it was taking years to process Immigrant Spouse Visas for spouses of American citizens but it was taking like 4 to 6 months to process a Fiancée Visa for the fiancée of an American citizen. So under the Life Act they created this thing called the K-3 which allowed basically folks with a spouse to process sort of in the K-1 Visa line if you will.

Now effectively, the K-3 as a practical matter is kind of a dead letter in most cases because of the Doctrine of Administrative Closure which is practiced by the National Visa Center wherein if the underlying Immigrant Visa petition makes the National Visa Center, so gets to the National Visa Center either before or semi-contemporaneously with the underlying Immigrant Visa petition, they go ahead and they just close the K-3 and they process the Immigrant Spouse Visa.

Do I see that changing going into 2024? Not really, and so for that reason I expect for another year at least, the K-3 will probably be a rarely utilized Visa, the supplemental K-3 petition will probably be a rarely sought after thing, at least in the context of Thailand going into 2024.
