Social Security Cards And K-1 Fiancée Visas

Transcript of the above video:

As the title of this video suggests, we are discussing the K-1 Fiancé(e) Visas. For those who are unaware, it is possible for an American citizen to petition the United States Government to bring in a foreign fiancé. For the purposes of this video we are going to presume we are talking about a Thai national but we do assist folks with cases arising for Myanmar nationals, Lao nationals, Cambodian nationals also possible, but the primary thrust of what we deal with in a US Immigration context is generally speaking, Thai nationals.

So what we are talking about here in this video is Social Security Card issuance. Once a person gets to the United States on a K-1 Fiancé(e) Visa and the K-1 Fiancé(e)  Visa is a Non-Immigrant Visa, it provides 90 days of lawful status in the United States during which time a person needs to go ahead and get married to their American citizen fiancé and then go ahead and apply for adjustment of status. Okay first things first, once adjustment of status is completed and a person has Lawful Permanent Residence in the United States, generally speaking a Social Security Card is going to be issued automatically as a matter of course because that Lawful Permanent Resident needs to have their Social Security number.

The question arising in cases involving K-1 Visas is 'what if my fiancé wants to work prior to the full adjudication of the adjustment of status?' Well there is something called an employment authorization document which can be sought by the Immigration apparatus and that employment authorization document, once issued can be used to request a Social Security number as well. Generally speaking it will be a temporary number until a permanent number can be basically obtained as a result of the approval on the underlying adjustment of status, so basically, once that person gets their Green Card.

But yeah, it is possible to get a Social Security number for a K-1 Visa holder if they are work authorized or once their adjustment is approved and they become Lawful Permanent Residents in the United States.
