Thai Prenuptial Agreements and CR-1, IR-1, and K-3 Visas

Transcript of the above video:

As the title of this video suggests, we are discussing prenuptial agreements. We are discussing them in the context of CR-1, IR-1 and K-3 Marriage Visas to the United States.

The reason for this video is prenups sometimes, not every couple is the same; not every couple has the same priorities, but we often times deal with a lot of prenups when we are dealing with clients that are getting their visa to the USA or they are looking to get their visa the USA. In many cases this used to be more common when we had the local USCIS office. We would assist a lot more in dealing with a prenup, marriage registration and then going ahead and getting the CR-1 or IR-1 case on file. In the case of the K-3 you still had to process through the US.

The reason for this video is yeah before folks get married, if they are looking at a prenup situation they want to go ahead and get that done, that can be accomplished. It is a good idea to have somebody that can deal with both the American and the Thai side when you are talking about it in the context of a Thai fiancée. Or even where you are living in Thailand and you may not both be Thai Nationals but you are living in the jurisdiction so you want things to be formalized in line so that in the event that there is a dissolution or something down the line, everything is in line in terms of formality with respect to the jurisdictions you are dealing with, in this case Thailand and the United States is kind of what we are presuming.

So yeah, prenups often do come up. They run alongside or concurrently when we oftentimes will deal with trying to help folks get back to the United States, get their spouse back the United States and it does have to be all wrapped up and done before the marriage can occur which then is a prerequisite to be able to file for the Visa.
