US Immigration, Unlicensed Practice of Law, and Human Trafficking?

As the title of this video suggests, we are discussing the unlicensed practice of law, US Immigration Law and issues pertaining to human trafficking. Now I have made videos here recently where I have talked about there a number of fraudulent, just completely fraud lawyers that are out here especially in Southeast Asia, especially outside the United States. In a South American vernacular, you will often hear these folks referred to as notarios. Unfortunately, here in Southeast Asia we just have some total frauds sometimes. I mean people that just claim to be lawyers that are not. They have no qualification as such; they are frauds, they are literal charlatans, that's exactly the terminology for those type of people, and they don't really see the legal quandary that they constantly put themselves in in the context of US Immigration Law.
As we've discussed in other videos, 8 CFR 292.1 under the Federal Code of Regulations in the United States, stipulates that only attorneys can take fees to exist in US Immigration matters. People just kind of overlook this and they play all kinds of games. You see a bunch of these charlatan types in the United States play all kinds of games with the wording of that, and unfortunately in the past - especially in the very recent past in this last Administration which is hard to call it that, when it was entirely run by auto-pen - but that being said, in this past administration there was a great disregard in my opinion for really any kind of laws especially associated with Immigration, and this needs to end. In the film The Firm, they point out that lawyers that help others, that facilitate the undermining or the subversion of law, are actually the worst type of perpetrators out there, and I can't think of folks that are any more deplorable under that sort of rubric than those who think even having the credentials to provide analysis, critical advice, and collusions based on the law, I can't think of anybody more fraudulent than somebody who fakes their credentials to be able to do that.
But the point I'm trying to make is it's those fakers that cause the worst problems, and the biggest problem is human trafficking as has been pointed out by Mr. Holman, the so-called Immigration Czar back in the United States, basically the guy who actually cares about enforcing American Immigration Law mostly via USCBP powers along the border from what I've seen, but I'm hoping that him as well as DHS more broadly, Department Homeland Security, will see that these fraudulent charlatans are more of a problem than maybe even some of the folks that are doing more “the rubber hits the road” sort of work if you will associated with trafficking people illegally, people will see that the folks that assist fraudulently, basically obtaining oftentimes sometimes fraudulent documentation to travel to different places especially the United States, could be engaging in human trafficking. The point I am trying to make for this video though, for possible folks who are looking to go to the United States and they just want to get their loved one there, they want to go through the legal process and do the steps correctly, you need to ascertain whether or not you are dealing with a licensed Attorney from the United States, again per 8 CFR 292.1, because anybody else who claims to be able to take fees in exchange for assisting with US Immigration, is in violation of that very relevant law, and if they are not licensed as an Attorney that's a real problem. So again, the thing to take away from this video, well actually, another thing to take away from this video is the fact that by engaging somebody who is one of these frauds, you could be putting yourself in harm's way, if for no other reason, your documentation and information is not privileged, okay. You are dealing with a fraudulent individual. It could actually be deemed that you are engaged in a conspiracy to engage in human trafficking if you are dealing with somebody who is not qualified and credentialed to be able to provide such Services.
I make this video not because necessarily it's like an attempt to gain more business. Anybody that actually knows me knows, US Immigration cases are not my favourite cases. I can do them but it's a living, okay. I don't live and die by my ability to do US Immigration. But that being said, I'm more making this video as sort of a public service because people can fall under the sway of these charlatans, and it can cause them all sorts of problems in a US Immigration context that could have really serious penalties under American Federal Law. Now I would like to see some of those penalties apply to these people who operate in this manner, but that said the warning to be taken from this video if you will is that look, you need to ascertain you are dealing with somebody legitimate because failure to do that could lead to some real problems and I think that's especially acutely the case moving forward in this second Trump Presidency.
