US K-3 Marriage Visa Processing in 2026?

As the title of this video suggests, we are discussing, well we are discussing basically the K-3 Marriage Visa. For those who are unaware, the K-3 is actually a creation, a later creation that did not exist under the original Immigration Act which was promulgated in the '50s. The K-3 was actually created under the Life Act, under President Clinton, at a time when the IR-1 and the CR-1 Visa categories were taking years to process and the Fiancé(e) Visas were taking like three to four months. So basically under that Act they created the K-3 and they said, "hey, if you're the spouse of an American citizen, you can process through this K-Line if you will, this K-3. category. You file a supplemental petition after you file for your Immigrant Spouse Visa benefits and then we will process get through on a faster track utilizing the supplemental petition. 

About 12 years ago, 15 years ago now I guess, back in about 2010-11 we saw the National Visa Center beginning to administratively close K-3 cases because the Immigrant Spouse Visa cases were coming through faster and so it was deemed that there wasn't a need for those. As time has gone on, it's been a real rarity that I've actually dealt with the K-3 or assisted people in filing for one. I have dealt with a couple on the back end for people who filed it themselves and processed it through and then they had problems and we came in to assist them in getting it finished up. Generally speaking, the K-3 is not as optimal as a CR-1 or an IR-1 Visa insofar as it does not confer Lawful Permanent Residence, so that's an important thing to think about. 

Now that said, how is the process going to look in 2026 or could there be changes? One possible change I could see is a lot less administrative closures of K-3 cases because I think we could see longer processing times associated with the underlying Immigrant Spousal Visa petition. It is not a foregone conclusion that we will see that but under a Trump Administration, I could see more possible roadblocks going up for those who are seeking Immigrant Spouse Visas, and they may find it conducive to getting their spouse into the United States faster to go ahead and file for a supplemental K-3. Again that's not a foregone conclusion, but that's just one possible development I could see happening with K-3 Visas going into 2026.
