US Tourist Visas from Thailand: 214(b) Strong Ties vs Weak Ties

As the title of this video suggests, we are discussing US Tourist Visas and we are discussing this in the context of section 214 (b) of the Immigration and Nationality Act which creates a framework wherein the Immigration Officer, well specifically I am looking at it from Consular Officers at a US Embassy for example here in Bangkok possibly the Consulate in Chiang Mai, is reviewing the case.

A lot of people ask me, "We are filing for a Tourist Visa. They denied it but she showed strong ties to Thailand. She has land”, usually it is oftentimes the fiancée or girlfriend or spouse of a US citizen when we are talking to folks and “she owns a house, she has a job”, well it is strong ties versus weak ties and weak ties sometimes is actually the harder thing to prove.

The thing to understand is that these Immigration Officers also operate under what is called the Doctrine of Consular Absolutism or the Doctrine of Consular Non-reviewability which basically stipulates that their fact-finding is not subject to review so if that Immigration Officer says that that person that applied for that Visa did not demonstrate sufficiently strong ties to Thailand and sufficiently weak ties to the United States then that Officer can go ahead and deny that case and that denial is really not subject to any kind of an appeal. 

The thing to think of or the thing to take away from this video, if you are serious about getting a Tourist Visa it may not be possible depending on the circumstances and if you are looking to get a Tourist Visa it may be a good idea to contact a legal professional, gain some insight and guidance into how best to proceed.
