What You Don't Know about Thai Marriage and US Immigration Can Be Perilous?
Transcript of the above video:
As the title of this video suggests, we are basically discussing, I wanted to call this video “you don't know what you don't know about US Immigration and Thai marriage”, but it's not a very good title, so that is kind of the preface to the video. You don't know what you don't know.
We get a number of inquiries and frankly we get a lot of surly responses when we say, “hey you need to set up a consultation and pay to have me basically go through your situation and review whether you should get married first, the immigration implications of getting married, how that is going to apply in your specific case”, because a lot of people think, one of the big misconceptions is that getting married actually speeds up the US immigration process. In many cases it does not, although I have to say in not all cases. There are circumstances where getting married may actually speed things up. Meanwhile, being unmarried and going for a fiancé(e) visa may be more advantageous again depending on your circumstances.
Meanwhile, marriage here in Thailand and things like prenuptial agreements, the interaction of the laws associated with those things and then the laws that may apply in the future regarding those issues in the United States for example, all of that is something of a witches brew that you need to be aware of all the nuances and implications going in and you need to basically have it all explained so that you can make the best decision based on your set of circumstances.
So basically, the thing to take away from this video is it's a bad idea to make assumptions or presumptions about how marriage works in Thailand, how it interacts with the Immigration System when you are looking at going back to the US and it's a bad idea generally to make assumptions and presumptions on top of that regarding marital estate issues and prenuptial agreements.
For those who find this a bit complex and overwhelming, first of all, don't be dismayed or frustrated, it is complex and somewhat overwhelming. I find it complex and overwhelming sometimes, and I have been doing this almost 20 years. So for those who do find it complex and somewhat overwhelming, it may not be a terrible idea to contact a legal professional, gain some insight and guidance into how best to proceed.
