"DSI Has Launched a Probe into 34 Companies" in Thailand?
Transcript of the above video:
As the title of this video suggests, we are discussing yet again issues involving probes of these companies, nominee structures etc. Let's just jump in here. I thought of making this video after reading a recent posting on X from Thai Enquirer, that is @ThaiEnquirer on X, quoting directly: DSI probes 34 Samui Phangan Firms Over Suspected Foreign Nominee Holdings. "The Department of Special Investigation (DSI) has launched a probe into 34 companies on Koh Samui and Koh Phangan in Surat Thani over suspected use of Thai nominee shareholders to conceal foreign ownership. DSI Chief Pol. Maj. Yutthana Praedam said the investigation follows discussions with the Department of Business Development (DBD) on cracking down on foreign-run nominee businesses in major tourist destinations." - important to point out that the Prime Minister of Thailand, Anutin Charnvirakul - we may make this the thumbnail actually for this video - Anutin Charnvirakul recently went to, he's been down to Koh Phangan on this specific issue, to check into what is going on with all of this stuff. As I discussed in another video, there was recently a raid by the Thai Army down there regarding a school, and when the Thai Army gets involved, you know it's serious. That said, quoting further: "Authorities analysed more than 11,426 companies on the two islands and identified dozens as high-risk. Of the 34 companies flagged by the DBD, around 20 were found to have assets exceeding 100 million Baht. Investigators are examining shareholder structures, ownership transfers and whether Thai shareholders have the financial capacity to legitimately hold shares or are acting on behalf of foreign investors. The probe will also determine whether the company's operating in sectors restricted under the Foreign Business Act. Firms found using nominee arrangements could face criminal prosecution as special cases. Officials said the investigation could later expand to other tourism hubs including Phuket, Krabi, Phanga, Pattaya, and Hua Hin."
Yeah, as I've said in other videos, they are not taking this lightly. This has actually gone beyond even being viewed as a law enforcement matter, it is now viewed as a national security concern as it pertains to national sovereignty. So again, this is not something to just shirk off.
As I have discussed in other videos, for those who already are doing business in Thailand, that already have companies, if you have concerns regarding their structure, it may not be a terrible idea to contact a legal professional, have them conduct due diligence and provide analysis as well as possible solutions or further options or alternatives in order to continue doing business here in the Kingdom of Thailand.
