The JADE Act and US Visas from Myanmar

Transcript of the above video:

As the title of this video suggests, we are discussing the JADE Act and US Visas from Myanmar, sometimes referred to as Burma, but for purposes of this video and basically generally speaking I just refer to as Myanmar now. So the JADE Act, and what does JADE stand for, J A D E?

It means Junta's Anti-Democratic Efforts Act. So what are we talking about here? Well basically, part of the Immigration process if you are coming out of Myanmar and we deal with these cases very infrequently but they do come up from time to time just because of Myanmar's proximity here to Thailand, they are a different kettle of fish. I am here to say it is not in any way similar to processing a case in Thailand or for a Thai national for a lot of different reasons. A perfect example of this is the JADE Act. Basically there is extra documentation associated with processing, especially Consular processing the Visa application for either an Immigrant or Non-Immigrant Visa to the best of my knowledge, which basically entails there is an extra document specifically dealing with the JADE Act that basically runs down whether or not the applicant has family relationships or any kind of business relationships with members of the so called Junta in Myanmar.

Now I am not going to get political, get into all of that, but long story short, pursuant to the JADE Act, there are a number of restrictions, restrictions down to just being unable to get a visa to the United States for certain folks who are associated with the so-called Junta over in Myanmar. So again, not to get overly political, just talking purely about the US Immigration implications, this is one of possibly myriad things that can cause slowdowns and delays in the Immigration process associated with trying to bring someone from Myanmar back to the United States. So something to bear in mind and something to bear in mind if someone has for example a family relationship that may call into question whether or not they can actually get the Visa because that might be something to get into with a legal professional before even getting the process started.
