Crackdowns on nominee structures in Thailand are continuing, especially in the context of land that is held by a nominee structure corporation whereby the land will most likely be seized or ordered to be sold.

Trust structures are not recognized under Thai Law and whereupon foreign nationals who wish to leave property in Thailand to their heirs, should best look into a separate Thai Will.

Having a Thai Will in Thailand is a necessity for expats who are not legally married as otherwise, upon their death, assets such as condos, bank accounts etc., most likely will revert to the state.

Foreign nationals with a Thai spouse who plan to draw up a Will, should also look into a usufruct which will give lifetime usage of any property to the foreign spouse which a Will does not provide.
